Terms of Service

1. Introduction

Welcome to Outback Adventures Pty Ltd ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, booking services, and other related services (collectively, the "Services").

Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not use our Services.

2. Eligibility

You must be at least 18 years old to use our Services and to make bookings. By using our Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding contracts.

If you are making a booking on behalf of others, you represent and warrant that you have the authority to act on their behalf and to bind them to these Terms.

3. Account Registration

To access certain features of our Services, you may need to create an account. When you create an account, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.

4. Booking and Payment

4.1 Booking Process

When you make a booking through our Services, you are offering to purchase a tour or related services subject to these Terms. All bookings are subject to availability and confirmation.

4.2 Pricing and Payment

All prices are displayed in Australian Dollars (AUD) unless otherwise specified. Prices may change at any time, but changes will not affect confirmed bookings.

Payment methods accepted include credit/debit cards, direct bank transfers, and other methods as specified at the time of booking. By providing payment information, you represent and warrant that you are authorized to use the payment method.

4.3 Booking Confirmation

Your booking is not confirmed until you receive a booking confirmation and invoice from us. We reserve the right to decline any booking at our discretion.

4.4 Deposit and Final Payment

A non-refundable deposit (typically 20% of the total tour price) is required to secure your booking. The final payment is due 60 days before the tour departure date unless otherwise specified. For bookings made within 60 days of departure, full payment is required at the time of booking.

5. Cancellation and Refund Policy

5.1 Cancellation by You

If you cancel your booking, the following cancellation fees apply:

  • More than 60 days before departure: Loss of deposit
  • 59-30 days before departure: 50% of total tour price
  • 29-15 days before departure: 75% of total tour price
  • 14 days or less before departure: 100% of total tour price

All cancellations must be in writing and sent to [email protected].

5.2 Cancellation by Us

We reserve the right to cancel any tour due to insufficient bookings, unforeseen circumstances, or events beyond our control. In such cases, you can choose between:

  • A full refund of the amount paid
  • Credit toward a future tour (valid for 18 months)
  • An alternative tour of equivalent value (if available)

We are not responsible for any incidental expenses or consequential losses that you may incur as a result of the cancelled booking, such as visas, vaccinations, non-refundable flights, or loss of enjoyment.

5.3 Changes to Bookings

If you wish to make changes to your booking, such as transferring to another tour or changing departure dates, we will try to accommodate your request, but cannot guarantee availability. A transfer fee of AUD $150 may apply, plus any additional costs resulting from the change.

6. Travel Insurance

Comprehensive travel insurance is mandatory for all participants on our tours. Your travel insurance must cover at minimum:

  • Emergency medical expenses including repatriation
  • Personal liability
  • Cancellation and curtailment
  • Loss of luggage and personal effects

You may be required to provide proof of insurance before the commencement of your tour.

7. Passports and Visas

You are responsible for ensuring that you have valid travel documents, including passports and visas, as required for the countries you will visit. Your passport should be valid for at least six months beyond the duration of your tour.

We are not responsible for any issues arising from your failure to obtain appropriate travel documentation.

8. Tour Conduct

You agree to comply with all reasonable instructions and directions of our tour leaders, guides, and representatives during your tour.

We reserve the right to remove you from a tour, without refund, if your behavior:

  • Endangers the safety or wellbeing of yourself or others
  • Violates the laws of any country visited
  • Is abusive, discriminatory, or threatening
  • Causes damage to property
  • Interferes with the enjoyment of other travelers

9. Intellectual Property

All content on our Services, including text, graphics, logos, images, and software, is the property of Outback Adventures or our licensors and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works of any content without our prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law, we disclaim all liability for any loss, damage, injury, or expense you may incur arising from:

  • Acts or omissions of third-party service providers
  • Acts of government authorities, natural disasters, strikes, civil unrest, or other events beyond our control
  • Personal injury or property damage
  • Delays, changes, or cancellations to itineraries
  • Loss or damage to personal belongings

Our aggregate liability to you for any claims arising under these Terms shall not exceed the amount paid by you for the tour or service that is the subject of the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Outback Adventures, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your use of our Services

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of New South Wales, Australia, and you consent to the jurisdiction of such courts.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. The updated version will be effective as of the date stated at the top of these Terms. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.
